Section 52C
Managing unruly residents:
(1) Regardless of what is written in the existing law, even if the land has been demarcated in Ailani or other government land or records at the time of commencement of this section, the land that has been converted into awabadi, for at least ten years ago, the unorganized residents who have been depopulated, will be provided with land for one time to increase the extent of the area specified by the Government of Nepal in the place where they are depopulating will be able to do
(2) Regardless of what is written in sub-section (1): unorganized residents Section 52B. If they are living on the land mentioned in sub-section (4), such land will not be provided to them.
(3) According to sub-section (1) when land is provided to the unsettled residents, the owner of the land can be made available by taking the prescribed fee according to the classification and classifying them based on their economic condition, residence status, nature of the land, area, assessment, period of occupancy and whether or not they have land elsewhere.
(4) If there is a situation where unorganized residents have depopulated the land more than the specified area, the Nepalese government can use the land exceeding the specified area for other purposes.
(5) When providing land for unorganized residents according to this section, land can be provided to the unorganized residents who have settled during land acquisition from among the government land occupied by them at the time of acquisition: Papers provided by the relevant body: The area mentioned in the proof.
(6) The land provided under this section shall not be transferred to any person for a period of ten years through any other process except in the case of shareholding and aputali.
(7) Pursuant to this section, the Government of Nepal shall give any irregular resident or his family: Government land. or housing has been provided, such person or family will not be provided with land according to this section.
(8) For the purpose of providing land in accordance with this section, identify the unorganized residents and take the survey, conduct on-site study and collect the evidence and provide the land.He also acts in section 52b. The commission according to subsection (6) will do.
(9) According to this section, other provisions regarding the provision of land shall be as prescribed. Explanation: For the purpose of this clause,-
(a) "Irregular resident" shall mean a person classified on the basis of sub-section (3) who has been living in a house or terrace for a long time, even though he is not registered in the official announcement, certificate or official record: and the term shall also refer to his dependent family members.
(b) "Ailani land" means land that has been depopulated for a long time, whether it is registered in the name of the government or not, even if it has been depopulated in the government records, or which has been given to depopulate at that time.
